Please read these Terms carefully. By accessing or using the ARC Visa Services Platform, you agree to be legally bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

Section 1
Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and ARC Visa Services ("Company", "we", "us", "our") governing your access to and use of the ARC Visa Services Platform ("Platform", "Service").

By accessing the Platform, clicking "Accept", or continuing to use the Service after being presented with these Terms, you confirm that:

If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Section 2
Description of Services

The ARC Visa Services Platform is a secure, web-based internal management system. The Platform provides the following services to authorised users:

Access to the Platform is provided through unique access keys (for individual users) or verified email/password accounts (for organisation administrators). Features available to you depend on your assigned access level and subscription plan.

Eligibility

The Platform is intended for professional use only. To use the Platform, you must:

User Accounts & Access Keys
4.1 Account Types

The Platform offers two types of access credentials:

  • Access Keys: Unique alphanumeric keys issued by an administrator to individual users. Used to access the credential vault and assigned visa records.
  • Organisation Accounts: Email and password-based accounts issued to organisation administrators, providing access to the multi-tenant management portal.
4.2 Account Security

You are solely responsible for maintaining the confidentiality and security of your access credentials. You must:

  • Not share your access key or password with any other person;
  • Use a strong, unique password for organisation accounts;
  • Log out of the Platform when your session is complete;
  • Notify us immediately at hr@arcvisaservices.com if you suspect unauthorised access to your account.
4.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating or maintaining your account. We reserve the right to suspend accounts with inaccurate or misleading information.

4.4 No Liability for Unauthorised Access

We are not liable for any loss or damage arising from your failure to keep your access credentials confidential. You are responsible for all activities that occur under your account.

User Responsibilities & Acceptable Use

You agree to use the Platform solely for its intended, lawful purpose. You must not:

Violations of these provisions may result in immediate account termination and may be reported to relevant legal authorities.

Section 6
Intellectual Property
6.1 Our Ownership

All content, software, features, functionality, designs, text, logos, trademarks, and technology comprising or delivered through the Platform are owned by ARC Visa Services or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

6.2 Licence Granted to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform solely for your authorised, internal business purposes.

6.3 Restrictions

You may not, without our prior written consent:

  • Copy, reproduce, or duplicate any part of the Platform;
  • Modify, adapt, translate, or create derivative works;
  • Distribute, sell, sublicense, lease, or transfer access to the Platform;
  • Remove or alter any proprietary notices or labels on the Platform.
6.4 Your Data

Visa credential data and other records you input into the Platform remain your property. By using the Platform, you grant us a limited licence to store, process, and display this data solely to provide the Service to you.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference and forms part of this agreement. By using the Platform, you acknowledge and consent to the collection, processing, and storage of your information as described in the Privacy Policy.

We implement industry-standard security measures to protect your data. For full details on what data we collect, how we use it, and your rights, please review the Privacy Policy.

Section 8
Subscriptions & Billing
8.1 Organisation Plans

Organisation administrator accounts are offered under subscription plans (Starter, Growth, Enterprise). Plan details, feature sets, pricing, and billing periods are communicated at the time of subscription and are subject to change with advance notice.

8.2 Plan Expiry

Access to organisation portal features will be suspended upon plan expiry. Your organisation's credential data is retained for 30 days following plan expiry. After this period, we reserve the right to permanently delete your data. We are not responsible for any consequences of data deletion due to non-renewal.

8.3 Refund Policy

All subscription fees are non-refundable except where expressly required by applicable consumer protection law. If you believe a charge was made in error, contact us at hr@arcvisaservices.com within 7 days.

8.4 Individual Access Keys

Access keys for individual users are issued and managed by organisation administrators. Billing for individual access is handled at the organisation level and does not result in direct charges to individual key holders.

Service Availability & Modifications
9.1 Availability

We strive to maintain high availability of the Platform but do not warrant or guarantee uninterrupted, error-free, or secure access at all times. Scheduled maintenance may temporarily interrupt service; we will endeavour to perform maintenance during off-peak hours.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any feature, functionality, or the entire Platform at any time, with or without notice, and without liability to you.

9.3 No Warranty of Availability

We do not guarantee that the Platform will always be available, that it will be free from viruses or errors, or that defects will be corrected. Use of the Platform is at your own risk.

Third-Party Services

The Platform integrates with or depends upon certain third-party services. Your use of the Platform may be subject to those third parties' own terms and privacy policies:

We are not responsible for the content, privacy practices, or availability of any third-party services. Links to third-party sites are provided for convenience only.

Section 11
Limitation of Liability
11.1 Exclusion of Damages

To the fullest extent permitted by applicable law, ARC Visa Services, its operators, employees, and affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages;
  • Loss of profits, revenue, business, data, goodwill, or anticipated savings;
  • Loss of visa appointment opportunities or adverse immigration outcomes;
  • Service interruptions or system failures beyond our reasonable control;
  • Unauthorised access to your account arising from your failure to secure credentials;
  • Accuracy or completeness of visa appointment information displayed on the Platform.
11.2 Cap on Liability

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of: (a) the total fees paid by you to us in the 12 months immediately preceding the claim, or (b) INR 5,000.

11.3 Essential Basis

The limitations of liability in this Section reflect a reasonable allocation of risk and form an essential basis of the bargain between the parties. We would not provide the Platform to you on these terms without such limitations.

Indemnification

You agree to defend, indemnify, and hold harmless ARC Visa Services and its operators, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

We reserve the right to assume exclusive control of any matter subject to your indemnification, at our expense, and you agree to cooperate with our defence of such claims.

Section 13
Termination
13.1 Termination by You

You may stop using the Platform at any time. Organisation administrators may request deletion of their account and data by contacting us at hr@arcvisaservices.com.

13.2 Termination by Us

We may suspend or permanently terminate your access to the Platform immediately and without prior notice if:

  • You violate any provision of these Terms;
  • We suspect fraudulent, abusive, or illegal activity;
  • Continued access poses a security risk to the Platform or other users;
  • Your subscription plan has expired and has not been renewed;
  • We are required to do so by law or court order.
13.3 Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. The following sections survive termination: Section 6 (Intellectual Property), Section 7 (Privacy), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 14 (Governing Law), and Section 15 (Dispute Resolution).

Section 14
Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You agree to submit to the personal jurisdiction of the courts located in Hyderabad, Telangana, India for the purpose of litigating any claim not subject to arbitration under Section 15.

Dispute Resolution
15.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at hr@arcvisaservices.com with a written description of your complaint. We will attempt to resolve the dispute within 30 days of receiving your notice.

15.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat and venue of arbitration shall be Hyderabad, India. The arbitration shall be conducted in English. The arbitral award shall be final and binding on the parties.

15.3 Class Action Waiver

You waive any right to commence or participate in any class action lawsuit, class-wide arbitration, or any other representative proceeding relating to these Terms or your use of the Platform.

15.4 Exceptions

Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Your continued use of the Platform after updated Terms are posted constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Platform immediately.
